Susie Wakefield is a partner at Shoosmiths LLP specialising in insurance and reinsurance litigation and arbitration. She is uniquely experienced in (re)insurance dispute work, having qualified and practised for many years in New York and Bermuda as well as in London. Susie has advised Bermuda, US, and London market insurers and reinsurers, as well as other market players, in litigation in federal and state courts in New York, the Supreme Court of Bermuda, and the High Court and in arbitration. She has represented clients in complex, multimillion-dollar disputes, including cases with substantive international and multijurisdictional aspects.
Susie advises on a range of matters including a broad array of claims and coverage disputes, issues arising in connection with Bermuda Form policies, and reinsurance arrangements involving captives and segregated account companies. She has advised (re)insurers on complex policy wording reviews; significant property and casualty losses; claims involving allegations of fraud, misrepresentation, and nondisclosure; breach of warranty claims; claims for contribution from coinsurers; and insolvency-related matters. Her work spans many lines of business including: CGL, property, construction, energy, space, marine cargo, financial lines including D&O, E&O/PI, financial institutions PI, pensions trustees liability, POSI and liability including product liability, product recall, public liability, employers' liability, IT, media, IP, and cyber.
Susie has handled numerous insurance and reinsurance (both facultative and treaty) coverage disputes in litigation and arbitration – under the Arbitration Act 1996, the Federal Arbitration Act, the Bermuda International Conciliation and Arbitration Act 1993, and the UNCITRAL Model Law as well as ad hoc arbitrations and those under various institutional rules in the UK, Europe, and the US (notably ARIAS US). Some of these matters arose out of historic market issues such as the Unicover PA facility. Others relate to high-profile losses such as Deepwater Horizon and Costa Concordia. Some were resolved successfully during the course of or shortly after mediation.
During recent years, Susie has been asked to advise on matters arising out of Insurance Linked Securities, insurance regulatory issues including those arising out of insuretech, tech-enabled products, as well as a variety of matters relating to cyber risks.
Susie co-authored the 'Lloyd's and London Market' chapter of volume seven of the New Appleman on Insurance Law Library Edition, 2012.
Susie qualified in the UK in 1997 and is also admitted to practise in New York (2003) and Bermuda (2008).
