Dr Olivier Favre is a partner in Schellenberg Wittmer's banking and finance group in Zurich. Olivier focuses on derivatives, structured finance and capital markets transactions, and advises clients on financial services, securities, commodities, fund, insurance and reinsurance regulation. He advises clients on financing and capital markets transactions and on fintech solutions and their legal implementation. His clients include financial institutions, buy-side firms, issuers, insurance companies and industry associations.
Olivier's recent expertise in banking and finance matters includes: advising on the implementation of fallback clauses for derivatives contracts referencing LIBOR benchmarks; advising on the compliance with initial margin requirements for uncleared OTC derivatives transactions; drafting the netting opinion published by the ISDA for international financial institutions set up in Switzerland; advising on the issuance of high-yield debt instruments; registering programmes for the issuance of structured products, warrants and debt instruments with SIX Swiss Exchange; advising on the issuance of stable coins backed by crypto assets; advising on Swiss law aspects of Brexit planning; and advising on the enforceability of a new master agreement for securities lending transactions with pledging of assets as collateral.
Olivier obtained a doctorate in law from the University of Zurich (iur, 2003) and a master's in law from Harvard Law School (LLM, 2004). For his doctoral thesis, he received the Issekutz Award for outstanding achievements in business law.
Prior to joining Schellenberg Wittmer as an associate in 2009, Olivier practised as an attorney in London, specialising in OTC derivatives and structured finance transactions, fund products and capital markets transactions. He also worked as an associate at Allen & Overy (2004–2007) and as legal counsel at Goldman Sachs (2007–2009).
