E Anthony Figg is a principal in the Washington, DC, law firm of Rothwell, Figg, Ernst & Manbeck, PC. He specializes in intellectual property law, primarily involving the chemical, pharmaceutical, healthcare, and biotechnology industries. His practice focuses on patent litigation and interferences, re-examinations, patent procurement, intellectual property licensing and related contract matters, opinions, and counselling.
Mr Figg has served as lead counsel in a large number of complex patent litigations in federal district courts, the International Trade Commission, and the Board of Patent Appeals and Interferences, as well as in appeals before the US Court of Appeals for the Federal Circuit and the Court of Appeals for the District of Columbia Circuit. He litigated some of the first cases arising from the Drug Price Competition and Patent Term Restoration Act of 1984 (the so-called Hatch-Waxman amendments) and continues to handle a large number of such cases. His trial and appellate practice includes the successful prosecution of groundbreaking cases involving the interpretation and application of the Hatch-Waxman amendments.
Mr Figg is a past chair of the Section of Intellectual Property Law (IPL) of the American Bar Association, the largest organization of patent attorneys in the world. He also served a four-year term on the IPL Section's Council and has chaired several of its divisions and committees. He notably chaired the IPL Section's Patent Law Reform Task Force for several years. He also has served on the ABA's Standing Committee on Amicus Curiae Briefs, and he is a former member of the ABA's Coordinating Committee on Bioethics. He is a member of the American Intellectual Property Law Association (AIPLA), the Executive Committee of AIPPI United States, the District of Columbia Bar and its Intellectual Property Law Section, and the Licensing Executives Society. Mr Figg is a Fellow of the American College of Trial Lawyers and the American Bar Foundation.
Mr Figg has been included annually in the Washington DC Super Lawyers list since 2007. He has been selected as a leading attorney by The Best Lawyers in America© since 2008, and he was named Lawyer of the Year in Washington, DC, in Litigation-IP in 2018, Litigation-Patent in 2013, and IP Law in 2011 by the publication.
Mr Figg received a JD from Indiana University School of Law and a BS in chemistry from Rose Polytechnic Institute (now Rose-Hulman Institute of Technology). He is admitted to practice before the Bar of the District of Columbia, the US Court of Appeals for the Federal Circuit, the US Court of Appeals for the District of Columbia Circuit, and the US Supreme Court. He is also registered to practice before the US Patent and Trademark Office.
