Trinath Tadakamalla, a partner based in the firm's Delhi office, focusses on the firm's disputes practice, specifically in the areas of insurance and reinsurance, energy, construction and engineering disputes arising out of insured projects, and subrogated insurance recoveries. He has been involved in commercial disputes and arbitrations and has acted for Indian and overseas clients in litigation in India and overseas. He represents a variety of insurers, reinsurers, insureds and intermediaries their claims and disputes arising out of the claims, and also regularly advises them on regulatory and contentious aspects.
He has represented insurers in one of the largest arbitrations in India heard by an international Tribunal. He has also advised and handled energy insurance claims and disputes (arbitration and litigation) on behalf of Indian insurers and European reinsurers from insurance of Indian refinery projects, off-shore oil drilling rigs, and onshore oil exploration operations. Advising upon and handling marine energy claims arising out of damage to offshore equipment being installed by overseas contractors (such as vessel impact damage to single buoy moorings, damage to moorings for underwater pipes caused by inclement weather, Tsunami damage claims). He has also handled industrial and property insurance claims and disputes (arbitration and litigation) on behalf of Indian insurers, including material damage and business interruption claims from large fertilizer units leading chemical plants, worldwide glass manufacturers, claims arising out of the Thailand floods, other flood and tsunami damage, cyclone damage claims and telecom claims. He has also handled professional indemnity claims and directors' and officers' insurance claims (including overseeing arbitration and litigation in various jurisdictions) for insurers, advising on coverage, and monitoring defence strategy, direction and costs.
He is also advising Indian insurers in respect of key insurance products being brought out by them in the Indian market, advising in respect of regulatory issues faced by them from time to time with respect to dealings with intermediaries. An example of this is the structuring of the Indian Nuclear Insurance Pool and the policy wordings under it.
