Welcome to the third annual edition of Benchmark Litigation, the definitive guide to America’s leading firms and attorneys.

Benchmark is the only publication on the market to focus exclusively on litigation in the U.S. Its researchers conduct extensive face-to-face interviews over a year-long period in order to get the most accurate feedback about the market.

In an effort to provide the most accurate and comprehensive coverage of the U.S. litigation market, we have taken a two-fold approach to our research. In the national section of the guide, we provide an overview of those firms and attorneys capable of handling complex cases anywhere in the country across all practice areas. We asked sources to name the best firms in the nation for any type of complex business matter, and ultimately we compiled a list of the firms showcased in this section. These firms are capable of handling any case effectively, and are consistently renowned within the U.S. business and legal community for the quality of their trial work and their litigation professionals.

Next, we highlighted the most consistently recommended “bet-the-company” firms and professionals in ten key business litigation practice areas including appellate, antitrust, bankruptcy, general commercial, insurance, intellectual property, international arbitration, products liability, securities, and white-collar crime. We polled leading legal professionals, in-house counsel, and business owners in each of these ten areas in order to determine the nation’s top firms and top partners in each category.

Regional and local expertise is also a crucial factor in high-stakes litigation, and in the second section of the guide we identify the leading litigation firms and partners in each of the 50 states and the District of Columbia.

Rankings of the top local litigation firms in the state
We divided the firms in each local market into “highly recommended” and “recommended” categories. All listed firms were consistently mentioned by peers and clients, but the “highly recommended” firms received the most mentions, and were held as dominant in their particular jurisdiction.
Rankings of the top “local litigation stars” in each state:
The list of “local litigation stars” for each state reflects only those individuals who were recommended consistently as reputable and effective litigators by clients and peers.
Rankings of the “future stars” in each state:
The list of “future stars” in each state reflects those partners who were consistently referenced by peers, competitors, and clients as litigators who are likely to appear as “local litigation stars” in coming editions.
Editorials on each of the ranked firms:
We have made every effort to offer in-depth coverage of the ranked firms. In some cases, however, we were not able to provide editorial content for every ranked firm due to a lack of participation or available information.

Recommendations are based on extensive face-to-face and telephone interviews with the nation’s leading private practice lawyers and in-house counsel. These interviews were conducted between February and June 2009. Firms cannot pay to be recommended. Instead, firms have been independently offered the opportunity to take a professional listing regardless of editorial content.
